Terms of Service

1. Acceptance of Services Agreement

This Services Agreement contains the terms and conditions governing use and the terms and conditions under which Power Instruments provides the Service to you. By accepting these Terms, or accessing or using the Services or the Site, or authorizing or allowing any Agent or End User to access or use the Services, you agree to be bound by these Terms.

 2. Service

2.1 Power Instruments Pte Ltd provides eGenkit Remote Monitoring solutions. Upon receipt of a request to grant user access, your registration constitutes your consent to Power Instruments using any personal data you provide to offer the services set out in our Privacy Policy.

2.2 You also acknowledge and agree that using the service does not relieve you of your legal and/or statutory obligations under the relevant laws.

2.3 Power Instruments does not guarantee that the customer’s use of the service will be uninterrupted or error-free; or that the services provided and/or the information obtained by the customer through the service will meet the customer’s requirements.

 2.4 Power Instruments  is not responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communication networks and facilities, including the internet, and the customer acknowledges that the service may be subject to limitation, delays and other problems inherent in the use of such communication facilities.

3. Intellectual Property Rights

3.1 Power Instruments owns all worldwide rights, copyrights, database rights, trade secrets, title and interest in and to the Services and the Website, Applications and Software Platforms used by Power Instruments to provide the Services.

3.2 You are not permitted to disseminate any information that is made available to you, as a licensee, by Power Instruments , including but not limited to login credentials.

4. Limitation of Liability

In no event shall Power Instruments , its officers, directors, employees, advisors, parent company, subsidiaries or assigns, be liable to any person for any indirect, incidental or consequential damages (including but not limited to business profits, business interruptions, loss of information and the like), in any way arising out of the delivery, performance, or use of the service. For any claim attributable to errors, omissions, or other inaccuracies in, or destructive properties of the service, or any other software or other content.

5. Miscellaneous

5.1 Power Instruments may revise these Terms from time to time, in which case the new terms shall supersede any previous versions.

 5.2 By entering this agreement, you acknowledge that you are transacting business with Power Instruments  in the Republic of Singapore. Any dispute arising out of or in connection with this agreement shall be referred to and finally and conclusively resolved by arbitration in Singapore in accordance to the Arbitration rules of the Singapore international Arbitration centre (SIAC Rules). The language of the arbitration shall be in English. In the event that recourse to the courts shall be necessary, the parties hereby submit to the exclusive jurisdictions of the courts of the Republic of Singapore.
